New York Freezes Data Centers: A Historic Decision Reshaping the AI Landscape

An Unprecedented Decision That Changes the Rules of the Game

In a first-of-its-kind precedent at the U.S. level, New York Governor Kathy Hochul issued an executive order suspending the issuance of permits for new high-capacity data centers within the state. The freeze applies to any project with a capacity exceeding fifty megawatts, a threshold that could impede the progress of more than twelve projects that were in the planning or preparation stages.

Governor Hochul clarified that the pause is temporary, tied to the completion of a comprehensive environmental review being conducted by the Department of Environmental Conservation. The review is expected to take approximately one full year before permit applications are considered again.

Why Now? Artificial Intelligence in the Hot Seat

This decision did not emerge overnight. Rather, it is the product of a sharp escalation in environmental and social concerns linked to the rapid expansion of data centers — an expansion driven in large part by the artificial intelligence boom. The enormous computing demands of training and running generative AI models have pushed technology companies to construct massive facilities that consume vast quantities of electricity and water, placing a growing strain on local power grids and natural resources.

A Pew Research Center survey found that only 10% of Americans express more enthusiasm than concern about AI applications in their daily lives, while just 23% believe the technology will improve the nature of work. In a separate poll, two-thirds of respondents expressed concern about rising electricity bills as a result of the proliferation of these facilities.

What Did the Governor Say?

At a press conference held in Brooklyn, Hochul summarized her position in firm terms:

• Technological progress should not come at the cost of higher electricity bills, water scarcity, or noise pollution.
• Data centers have no right to circumvent local urban planning decisions or municipal licensing requirements.
• These facilities should only be built in communities that genuinely welcome them.

The Governor also noted that her office is considering requiring project owners to contribute to a fund supporting the electrical grid, as well as revoking tax exemptions from the largest hyperscale data centers.

A Rising Legislative Wave

Hochul's executive order came amid a broader legislative push within the New York State Legislature. The legislature recently passed a bill calling for a one-year moratorium on the construction of data centers exceeding twenty megawatts, while a separate bill proposing a three-year freeze is still being debated in committee.

At the national level, more than 230 organizations have previously called for a comprehensive federal moratorium on new data center construction. Senator Bernie Sanders put forward a similar proposal that has yet to gain significant traction. In Maine, the legislature passed a comparable freeze bill before the governor vetoed it.

A Massive Future and Conflicting Forecasts

It is worth noting that the average size of data centers built in recent years has been under one hundred megawatts. However, projects currently under development are trending toward considerably larger scales. BloombergNEF projections indicate that nearly a quarter of new data centers built by 2030 will exceed 500 megawatts in capacity, driven by the continued surge of investment in artificial intelligence.

At the same time, this decision may put New York on a direct collision course with the federal administration under President Trump, which has adopted a supportive stance toward data center expansion. The Federal Energy Regulatory Commission has directed grid operators to accelerate the connection of these facilities to the electrical network.

A Shift in Public Sentiment

What makes this development particularly noteworthy is not the decision alone, but the context that gave rise to it. Just a few years ago, U.S. states were competing to attract data centers as valuable engines of economic development. Today, public opinion has shifted considerably, and these facilities are being met in some communities with skepticism and outright opposition rather than open arms — a signal that could fundamentally reshape AI-related development policy for years to come.
